Parties and scope
These terms govern domain sales made through XDomain. By purchasing a domain you accept them.
Seller: XDomain, 4 Peddlers Row, Unit #155, Newark, Delaware 19702, United States.
Price and currency
All prices are in US dollars (USD) and charged in dollars. If your card is denominated in another currency, your bank sets the conversion rate and any foreign transaction fee; those amounts are outside XDomain's control.
The listed price is the sale price. Prices may be updated without notice; the price in effect at the moment of payment applies.
Ownership and transfer
Every domain offered here is registered to XDomain. The transfer starts once payment completes and takes about 3 business days.
For .com, .net, and .org the transfer uses an authorisation code. For .com.tr, .tr, and .net.tr the transfer runs through nic.tr and the buyer needs a nic.tr account.
Ownership passes to the buyer at the moment the transfer completes at the registry.
Refunds
If the transfer fails for a reason attributable to XDomain, the full amount is refunded without deduction.
Once the transfer completes, the domain counts as a delivered digital product and the right of withdrawal no longer applies. Where a transfer cannot complete within 30 days because the buyer hasn't supplied the required details, refund requests are reviewed case by case.
Buyer responsibilities
Assessing whether use of the domain could infringe a trademark in a given field is the buyer's responsibility. XDomain makes no undertaking that a domain can be registered as a trademark in any particular sector.
Renewal fees, DNS configuration, and use of the domain after transfer are the buyer's responsibility.
Limitation of liability
XDomain's liability is limited to the amount paid for the domain in question. Indirect damages, lost profit, and reputational loss fall outside this scope.
Governing law
These terms are governed by the laws of the State of Delaware, USA. The courts of the State of Delaware have jurisdiction.
